How is Property Divided during Divorce?

​DC Code 16-910(a) governs the division of marital property. First, the court decides whether property at issue in the cases "separate" or "marital" property. Separate property that was acquired solely by one spouse prior to the marriage, or which was acquired by solely by one spouse during the marriage through gift, bequest, devise or descent, or property that was exchanged for such property. Upon divorce, separate property will be assigned to the spouse who was the sole owner of the property. Marital property is property that was acquired during the marriage.Upon divorce, the court will divide marital property and debt among the spouses according to the principle of equitable distribution.
